The Bombay High Court had reserved its order February 1 on the petition filed by Rabia against CBI's charge sheet which said the death of her daughter Jiah Khan was due to suicide and not homicide.

Rabia, in her petition, sought formation of a special investigation team and monitoring of the probe by high court. In her petition, she claimed her daughter's death on June 3, 2013 was not suicide as claimed by the CBI, but was homicide. According to Rabia, Jiah was murdered by her then boyfriend-actor Sooraj Pancholi.

While hearing the petition in February last year, the high court had stayed the trial against Sooraj.

Sooraj was arrested for abetting Jiah's suicide on June 10, 2013, but released on July 2 that year after the HC granted him bail. The case was transferred to CBI by the high court in July 2014 on Rabia's petition that the police were not investigating it properly.

Rabia had sought the SIT probe alleging that CBI,had concurred with the findings of Mumbai police that it was a case of suicide case and not a homicide. She had earlier moved the Supreme Court seeking SIT probe, but the apex court asked her to move the high court.

Rabia's lawyer argued that "investigation should be handed over to the SIT as CBI has also in its charge sheet said the death was not homicidal, despite forensic evidence suggesting otherwise."

Rabia's petition further said that they had obtained opinion from three doctors, including a foreign expert. All the three doctors had come to conclusion that Jiah Khan's death was homicidal and not suicidal, her petition contended.

CBI, however, opposed Rabia Khan's plea for an SIT probe, saying every angle had been investigated, CBI had double checked the evidence and come to the conclusion that it was a suicidal death.
